The First Chamber agreed, 26 January, on the new Act on the Deregulation Review of the Employment Relationship (Wet deregulering beoordeling arbeidsrelatie (DBA)), it will be implemented on 1 May 2016.
The Dutch government have a active manpower strategy that promotes an employment relationship that is flexible.
Presently a freelancer or a ZZP’er needs a Declaration of Independent Contractor Status (Verklaring Arbeidsrelatie, VAR) as a proof for their clients that they will not be held responsible for any payroll taxes with regard to these independent contractors working for them. With this declaration the Dutch Tax and Customs Administration states that they consider an individual as an independent entrepreneur.
De zogenoemde Verklaring arbeidsrelatie (VAR) voor zzp’ers lijkt zijn langste tijd te hebben gehad. In de Eerste Kamer tekende zich dinsdagavond een meerderheid af die een afschaffing per 1 mei steunt.
De VAR is bedoeld om bedrijven duidelijk te maken of zij loonheffing moeten inhouden en betalen over inkomsten van zzp’ers. Staatssecretaris Eric Wiebes (Financiën) wilde al langere tijd af van de VAR, maar hij stuitte op verzet in de Senaat. Hij deed een reeks toezeggingen. Zo komt er een langere overgangsfase van een jaar.
De VAR wordt vervangen door modelovereenkomsten. Die moeten zzp’ers en bedrijven meer duidelijkheid en zekerheid geven.
Bij een VAR kunnen mensen op papier werken als zzp´er terwijl ze in de praktijk eigenlijk gewoon in dienst zijn. Dat is lastig te controleren voor de Belastingdienst en financiële gevolgen zijn altijd voor de zzp´er.
